1. About these terms

These terms govern your use of Scapesome, a planning tool for planted aquariums available at scapesome.com and studio.scapesome.com (the “Service”). “We”, “us” and “our” mean the operator of Scapesome. By using the Service you agree to these terms. If you don’t agree, please don’t use it.

We may update these terms from time to time. When we do, we’ll change the date above, and if a change is significant (for example to pricing or to what a plan includes) we’ll tell you before it takes effect. If you keep using the Service after a change takes effect, you accept the updated terms.

2. Your account

You can place a tank and browse the library without an account. Tank reviews, follow-up questions and grown-in images require one.

You must be at least 13 years old, or the minimum age required where you live, to use the Service.

You’re responsible for keeping access to your sign-in email or Google account secure, and for activity under your account.

3. Acceptable use

Don’t use the Service to break the law, upload content you don’t have the right to use, or upload other people’s personal information.

Don’t try to get around credit costs, usage limits or payment; don’t scrape or copy the library in bulk; don’t resell access; and don’t interfere with the Service or other users.

We may suspend or close accounts that break these rules.

4. Your content

Your tanks, uploads, custom items and questions remain yours. You give us a limited licence to store and process them only to provide the Service to you: saving your tanks, reviewing them and generating their images.

We don’t sell your content, use it for advertising, or use it to train AI models. Images you create are yours to use and share.

5. Our content

The Service, including the library, species data, 3D models, software and branding, belongs to us or our licensors. You may use it through the Service for your own planning, but not copy, redistribute or build a competing product from it.

6. AI-generated content

Grown-in images, tank reviews and answers to your questions are generated by AI models working from species data and a set of rules. AI output can be wrong, incomplete or inaccurate, and two runs on the same tank can give different results.

This content is for general information and planning only. It is not professional advice, and it is not a guarantee of how your tank, plants or animals will turn out. Please check anything important, especially anything that affects the health of your animals, before you rely on it.

You decide whether and how to act on it. To the extent permitted by law, we are not responsible for any loss that results from relying on AI-generated content, for example plants or animals that die or don’t thrive, or materials and equipment you bought that turn out not to suit your tank.

7. Plans, credits and payment

Placing and browsing are free. Reviews, questions and images use credits. Plus costs $19.99 a month or $179.99 a year and includes 1,200 credits a month; Pro costs $39.99 a month or $359.99 a year and includes 3,000 credits a month. Prices are in US dollars and may not include taxes that apply where you live.

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time in Settings; you keep your plan until the end of the period you’ve paid for.

Monthly plan credits don’t roll over. Credit packs expire 12 months after purchase. Credits have no cash value and can’t be transferred.

If a payment fails, your paid plan ends. Your tanks, versions and images are kept.

Payments are processed by Stripe. We never see or store your full card number.

8. Refunds

Payments are non-refundable except where required by law. If you were charged by mistake or something went wrong, contact us within 14 days of the charge and we’ll look into it.

If you have a legal right to cancel a digital purchase where you live (for example in the EU or UK), that right is not affected.

9. Changes to the Service and ending your account

We may add, change or remove features. If a change significantly reduces what a paid plan includes, we’ll tell you before it takes effect.

You can delete your account at any time in Settings. Deletion is permanent and removes your tanks and data.

We may suspend or close an account that breaks these terms, or stop offering the Service. If we stop the Service, we’ll give you reasonable notice and you can ask us for a copy of your data.

10. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind. We don’t guarantee it will be uninterrupted or error-free, or that any review, answer or image will be accurate or suitable for your tank.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, including the loss of animals, plants, materials or equipment.

If we are ever found responsible for a loss, the most we will pay you in total is the amount you paid us in the 3 months before the claim.

Any claim relating to the Service must be brought within one year after the problem first arose. After that, the claim is waived.

Nothing in these terms limits any liability that can’t be limited by law.

12. Governing law

These terms are governed by the laws of Singapore, and disputes will be handled by the courts of Singapore. If you are a consumer, you also keep any protections the law where you live gives you.
